Is my unit exempt from the limit?

The guideline doesn't apply to new buildings, additions to existing buildings, and most new basement apartments that were first lived in as homes after November 15, 2018. For those units there's no limit on the amount, but the rent can still only go up once every 12 months, with 90 days' written notice on a Landlord and Tenant Board form.

It also doesn't apply when a new tenant moves in: the landlord can set the starting rent for a new tenancy. Community housing and long-term care homes have their own rules.
